Terms and Conditions
This is a non-refundable fee to be paid prior to starting a service inspection. It covers time spent by the technician to disassemble, diagnose and assess the problem in order to ascertain a cause and resolution.
Virus/Trojans/Spyware/Adware/Fake ware/Updates/Applications Changes/Cache/Script affects/Process conflicts that damage or change an Operating System or Software environment are not covered under any warranty. Craig Computers agrees to take all reasonable measures to protect a Client’s computer system from computer Viruses, Spyware & Adware. The Client assumes all risk for computer Viruses, Spyware & Adware and will not hold Craig Computers responsible. The Client is responsible for the costs of consulting time and materials required to remove any computer Viruses, Spyware or Adware.
Changing the working environment may impact on software efficiency. Using other applications like Microsoft Outlook may not work due to a different network setup/layout whether dial up, high-speed or wireless.
The clarity of details provided to the technicians at Craig Computers will influence the speed of diagnosis and repair. Please ensure notes provided are clear and concise. Problems not stated in the job notes cannot be diagnosed. If in doubt Craig computers will endeavor to seek clarification to avoid any misunderstanding.
Craig Computers can attempt to repair electronic products with liquid damage but there is NO WARRANTY on any liquid damage repairs.
PERSONAL DATA & CONFIDENTIALITY
The Client assumes all risk of data loss from any and all causes or in any way related to or resulting from the repair or service of computer hardware, software or other equipment by Craig Computers. The Client agrees to bear full responsibility for all data backup prior to any repair or service of computer hardware, software or other equipment by Craig Computers. The Client hereby indemnifies Craig Computers from any claim or liability related to data loss for any reason whatsoever. We will maintain as secret and confidential all information we obtain from you in providing the Services and will not use that information for any reason other than as necessary for providing the Services. This obligation will not apply to information that is in the public domain or that is known to us or obtained by us without breaching any obligation to you or that we are required to disclose by law.
Despite the purchaser having possession of any hardware or software, ownership is retained by Craig Computers until the client pays all money owed to Craig Computers. Risk in any goods supplied shall pass to the client at the point of delivery.
All QUOTES PROVIDED ARE ESTIMATES
Actual repair costs may differ from the quote. Should this situation arise Craig Computers will advise you of any significant variations to the quote.
If in the unlikely event that the first repair fails, a second quote will be provided and initial repair costs will not apply.
ITEMS HELD BY CRAIG COMPUTERS
All items not claimed within 30 days once a quote is issued or a repair job is completed, will be recycled. At which point Craig Computers is no longer liable to the client or any third party. Any bad debts will be passed to a debt collector.
We may immediately terminate the agreement for services if we consider:
(a) You are in breach of these Terms and Conditions;
(b) There is any threat to the safety of any of our staff or agents;
(c) There is presence of unlicensed or illegal software;
(d) Your equipment contains any pornographic, obscene, offensive or illegal content; or
(e) You are insolvent, bankrupt, in liquidation, unable to pay your debts, or otherwise an unacceptable credit risk.
(f) If we terminate our agreement we will cease services and all fees incurred up to that time will immediately become payable.
Craig Computers will not be liable for (whether in contract, tort or negligence)
(1) Loss of profits or savings, loss of goodwill or opportunity, loss or corruption of data, or wasted staff time; or
(2) Loss, damage, cost or expense of any kind whatsoever which is indirect, consequential, or of a special nature, arising directly or indirectly from any Services or Products supplied by us to you, even if we had been advised of the possibility of such loss, damage, cost or expense.
To the extent allowed by law, our total liability under any claim of any nature arising directly or indirectly from any Service or Product will not exceed the Fees paid by you for that Service or Product. You agree to indemnify us against any and all liability, losses, damages, costs and expenses of any nature whatsoever awarded against, incurred or suffered by us, whether direct or consequential, arising out of or resulting from your breach of clause.
Craig Computers will not be liable for any losses of any kind or any delay in performing obligations caused by any natural disaster, flood or earthquake, strike, lockout, fire, war, civil commotion, network service failure, inability to obtain products or supplies including the imposition of any export or import bans, or any other cause beyond its reasonable control.
CANCELLATION OF ON-SITES
The client is required to notify Craig Computers of any cancellation a minimum of 4 hours ahead of the scheduled start time. Failure to provide such notice will result in the minimum callout fee being charged.
